Woman in Kris Humphries Beverly Hills herpes case claims emotional distress

A woman who alleges Washington Wizards forward Kris Humphries gave her herpes simplex type 1 during a September 2010 encounter at the Thompson Beverly Hills hotel says she has stopped dating and isolated herself.

Parts of plaintiff Kayla Goldberg’s deposition, taken in November, are included in her lawyers’ opposition to the NBA player’s motion to dismiss her case.

Humphries’ attorney, Lee Hutton, asked Goldberg to elaborate on the alleged emotional distress she claims to have suffered since being diagnosed with the virus.

“I have become very hermit — or a hermit,” Goldberg testified. “I don’t have a — it’s just gone through phases and ups and downs and I have — will have emotional breakdowns and there are times when I can just cry and cry.”

Goldberg said she didn’t have a love life.

“There’s — a dating life is nonexistent,” she said. “I just don’t have much confidence or my confidence has decreased.”

Four or five days after being intimate with Humphries, she said she got a fever, aching bones and a sore throat. She said a genital sore began about two days after the initial symptoms.

Asked by Hutton how she could be sure she did not have herpes before meeting Humphries, Goldberg replied, “I never had any complications or symptoms or outbreaks before.”

When Hutton inquired whether she asked Humphries if he had herpes, Goldberg said she did not.

“I was trying to comprehend it myself,” she said. “I was in a lot of pain and I was worried about myself more than anything.”

Goldberg said she did not call Humphries in 2011.

“First of all, I wouldn’t think he would remember me,” Goldberg said. “Any why would I? I didn’t need to contact him.”

Goldberg sued Humphries, now 29, in Los Angeles Superior Court in August 2012, alleging sexual battery, negligence and negligent infliction of emotional distress.

Her suit states they met while having lunch with friends at the Newsroom Cafe in West Hollywood. Before leaving, they exchanged phone numbers and made plans to meet at a nightclub, according to the suit.

In his deposition, taken November in Waltham, Mass., Humphries was asked about his sexual experience with Goldberg.

“I don’t remember a lot from it,” he replied.

Humphries said that he used a condom “from what I can remember” and typically does “unless I’m in a relationship with someone.”

Goldberg’s lawyers say Humphries’ condom broke during sex with Goldberg but he did not want to tell her.

A hearing on Humphries’ motion to dismiss Goldberg’s case is scheduled Oct. 15.

Humphries married Kim Kardashian in August 2011 and they split 72 days later.
